    Hazardous Wastes (Management and Handling) Rules

    The Hazardous Wastes (Management and Handling) Rules, 1989 (‘the Rules’), as amended in by the Hazardous Waste (Management and Handling) Amendment Rules, 2003 apply to the handling of hazardous waste and harmonise the legal framework in India with international environmental laws.

  • Requirements

    Under Section 8 of the Rules, occupiers or operators of a facility or any association of occupiers shall be jointly and severally responsible for identifying sites for establishing the facility for treatment, storage and disposal of hazardous wastes. 

    Under Section 16 the occupier, transporter and operator of a facility shall be liable for damages caused to the environment resulting due to improper handling and disposal of hazardous waste and shall also be liable to reinstate or restore damaged or destroyed elements of the environment at his cost, failing which the occupier or the operator of a facility, as the case may be, shall be liable to pay the entire cost of remediation or restoration.
