Law on the Prevention and Control of Occupational Diseases

The Law of the People’s Republic of China on the Prevention and Control of Occupational Diseases, as amended (only available in Chinese here) (the Law) establishes requirements for the protection of workers from occupational health hazards and related rights. In particular, the Law applies to disease control and prevention within China and provides for regulations for safe working environments, as well as specifying responsibilities in regards to workers health.

  • Requirements

The Law does not specify third party requirements and the Laws provisions are explicitly directed at employers. Article 5 of the Law stipulates that employershall assume responsibility for occupational disease hazards arising from their own units.
