    Occupational Health and Safety

    Law no. 6514 of December 22, 1977, which modifies Chapter V of Title II of the Codification of Labour Laws relating to occupational safety and health (‘the Law’) (only available in Portuguese here). This places obligations upon public bodies, companies and their staff to adhere to appropriate health and safety measures.

  • Article 157 of the Law, provides that companies are recommended to; 

    • comply with and enforce appropriate standards of safety and occupational health; 
    • instruct the employees, through work orders, on the precautions to be taken in order to avoid occupational accidents or diseases; 
    • adopt the measures determined by the competent regional body; and 
    • facilitate the exercise of supervision by the competent authority. 

    Article 158 of the Lawprovides that employees are recommended to: 

    • observe the norms of safety and occupational health, including the instructions referred to in item II of the previous article; 
    • collaborate with the company in the application of the provisions of this Chapter. 

    Article 161(4) of the Law provides that, in addition to appropriate criminal measures, the Regional Labour Delegate shall be liable for disobedience, who, after having determined the prohibition or embargo, ordering or permitting the operation of the establishment or of one of its sectors, the use of machinery or equipment, as a result of damage to third parties.
